Responsible AI Policy

Freelance Labs Inc. ("Freelance Labs," "we," "our," or "us") provides this Responsible AI Policy to describe how we develop, deploy, and oversee artificial intelligence systems used in connection with our services, including Braintrust AIR, our AI-enabled recruiting and interview platform.
Freelance Labs is committed to responsible, transparent, secure, and human-centered use of artificial intelligence. This Policy describes our approach to AI governance, fairness, privacy, security, human oversight, and regulatory compliance.

1. Scope
This Policy applies to artificial intelligence systems developed, operated, or made available by Freelance Labs, including Braintrust AIR and related AI-assisted recruiting, screening, interviewing, and candidate evaluation workflows.
This Policy applies to Freelance Labs employees, contractors, service providers, and other personnel involved in the design, development, testing, deployment, operation, review, or oversight of AI systems.
2. Our Use of Artificial Intelligence
Freelance Labs uses artificial intelligence to help customers improve recruiting workflows, including by supporting structured candidate interviews, generating interview transcripts, producing role-specific skill scorecards, identifying relevant candidate information, and helping hiring teams review candidate responses more efficiently.
Braintrust AIR is designed to assist human decision-makers. It does not independently make final employment decisions. Customers remain responsible for their own hiring, promotion, compensation, termination, and other employment-related decisions.
AI-generated outputs should be reviewed by qualified human personnel and considered together with other relevant information.
3. Responsible AI Principles
Freelance Labs follows the following principles when developing and operating AI systems:
3.1 Human Oversight
We design AI systems to support, not replace, human judgment. Customers should maintain meaningful human review over employment-related decisions and should not rely solely on AI-generated outputs where prohibited by law or where human review is required.
3.2 Fairness and Bias Mitigation
We seek to reduce the risk of unlawful bias and adverse impact in AI-assisted hiring workflows. Our approach includes structured evaluation criteria, consistent interview design, testing, monitoring, and independent third-party assessments where appropriate.

3.3 Transparency
We seek to provide clear information about how our AI systems are intended to be used, the types of outputs they generate, and the limitations of those outputs.
Where required by law, Freelance Labs supports customer obligations relating to candidate notices, disclosures, accommodations, and transparency regarding AI-assisted employment assessments.
3.4 Privacy and Data Protection
We design AI systems with privacy and data protection in mind. Personal information processed through our services is handled in accordance with our Privacy Policy, customer agreements, applicable data protection laws, and internal data governance controls.
3.5 Security
Freelance Labs maintains security controls designed to protect customer and candidate data. Our security program includes access controls, encryption, monitoring, vulnerability management, vendor oversight, incident response, and periodic independent assessments.

3.6 Accountability
Freelance Labs maintains governance processes for reviewing AI-related risks, including security, privacy, fairness, reliability, legal, and operational risks. AI-related risks are reviewed as part of our broader risk management and compliance program.
3.7 Reliability and Performance
We test and monitor AI systems to help ensure they operate as intended. Because AI systems may produce incomplete, inaccurate, or unexpected outputs, users should apply independent judgment and review AI-generated information before acting on it.
4. AI Governance and Risk Management
Freelance Labs maintains governance processes intended to identify, assess, and manage risks associated with AI systems.
These processes may include:
- Product and engineering review
- Security and privacy review
- Data protection review
- Risk assessments
- Bias and adverse impact testing
- Vendor and third-party review
- Incident response procedures
- Change management
- Periodic policy review
We may update our governance practices over time as laws, standards, customer expectations, and AI technologies evolve.
5. Bias Auditing and Fairness Reviews
Freelance Labs recognizes that AI-assisted employment tools may raise important fairness and bias considerations.
Braintrust AIR has undergone an independent bias audit conducted by a third-party auditor. The audit assessed Braintrust AIR under the framework of New York City Local Law 144 regarding automated employment decision tools.

Freelance Labs may perform additional reviews, audits, or assessments as required by applicable law, customer requirements, or internal governance processes.
6. Customer Responsibilities
Customers are responsible for determining whether and how to use Freelance Labs services in their hiring workflows.
Customers are responsible for:
- Reviewing AI-generated outputs before making employment decisions
- Providing candidate notices where required
- Offering accommodations or alternative processes where required
- Complying with employment, labor, privacy, anti-discrimination, and AI-specific laws applicable to their use of the services
- Ensuring that hiring decisions are lawful, job-related, and based on appropriate criteria
- Configuring and using the services in a manner consistent with applicable law and customer policies
Freelance Labs does not control a customer's final employment decisions.
7. Candidate Rights and Accessibility
Freelance Labs supports fair and accessible participation in AI-assisted hiring workflows.
Depending on applicable law and the customer's use of the services, candidates may have rights to receive notice, request accommodations, access certain information, or request additional review.
Candidates with questions about a specific job opportunity, hiring process, accommodation, or employment decision should contact the employer or hiring organization directly.
8. Third-Party AI Systems and Service Providers
Freelance Labs may use third-party technologies, infrastructure providers, AI systems, and service providers to support our services.
We maintain vendor review and third-party risk management processes designed to assess security, privacy, confidentiality, availability, and compliance risks associated with relevant service providers.

9. Regulatory Alignment
Freelance Labs monitors and evaluates AI-related laws, regulations, and standards that may apply to our services.
Our AI governance program is informed by frameworks and requirements such as:
- New York City Local Law 144
- U.S. federal, state, and local employment and anti-discrimination laws
- EEOC guidance regarding AI and employment selection procedures
- NIST AI Risk Management Framework
- OECD AI Principles
- GDPR and UK GDPR
- CCPA/CPRA
- ISO/IEC AI governance principles
- European Union Artificial Intelligence Act
Freelance Labs is actively progressing its EU AI Act readiness program and is targeting completion of applicable compliance activities by August 1, 2026, subject to evolving regulatory guidance and implementation requirements.
10. Prohibited Uses
Customers and users may not use Freelance Labs AI systems to:
- Violate applicable laws or regulations
- Engage in unlawful discrimination
- Use emotion-recognition or affect-inference technology to assess candidates
- Make employment decisions without required human review
- Conduct unauthorized surveillance
- Infer or use sensitive characteristics in a prohibited manner
- Harass, exploit, or harm individuals
- Misrepresent AI-generated outputs as final employment decisions by Freelance Labs
- Circumvent security, privacy, or compliance controls
Freelance Labs may investigate suspected misuse and take appropriate action, including suspension or termination of access.
11. Security and Compliance Resources
Freelance Labs makes certain security, privacy, compliance, and AI governance resources available to customers and prospective customers.

12. Changes to This Policy
Freelance Labs may update this Responsible AI Policy from time to time. Any changes will be effective when posted unless otherwise stated.
Where required by law or contract, we may provide additional notice of material changes.
